On April 1st, 2024, the Florida Supreme Court handed down two decisions that greatly effect abortion law in our state.

While we celebrate the 6-week ban, we are looking ahead towards November when we must uphold LIFE at the ballot box.

“I encourage everyone in FL to vote “NO” in Nov. on the Amendment to Limit Abortion because if it passes, abortion will be allowed up to birth with the consent of any healthcare provider, not just a doctor.”

What Do I Need to Know about Amendment 4?

Amendment 4 – the Amendment to Limit Government Interference in Abortion – states the following:

“No law shall prohibit, penalize, delay, or restrict abortion before viability or when necessary to protect the patient’s health, as determined by the patient’s healthcare provider. This amendment does not change the Legislature’s constitutional authority to require notification to a parent or guardian before a minor has an abortion.”

What exactly does this mean?

  • Abortion is legal up to viability for all (23-24 weeks gestation)

  • Abortion is legal up to birth with the consent of a medical provider (not necessarily a qualified doctor)

  • No parental consent is required for an abortion to be performed on a minor

What can I do to help?

Vote NO!

The biggest difference in this amendment will be made at the ballot box. Vote NO to Amendment 4.

What is legal today?

As of May 1st, 2024, abortion in Florida will be illegal past 6-weeks gestation. A few things to note:

  • Though the law is technically called the Heartbeat Protection Act, it limits abortion based on gestational age, not when a heartbeat is detected. Abortion is legal up to 6-weeks gestation.
  • Miscarriages and ectopic pregnancy care are NOT abortions, and women will not be denied medical care for miscarriages or ectopic pregnancy.
  • The abortion pill must be administered in person by a physician, outlawing the dispensing of the pill through mail.
  • Exceptions to the law exist in cases of rape, incest, human trafficking, fatal fetal abnormality, or when the pregnant woman’s life is in danger.
